Judgments rendered by foreign courts have no binding force by themselves in another State. On one hand,Parties are interested in transnational legal certainty and in avoiding repeated litigation and conflicting decisions. Secondly, they have an interest in avoiding resources spent on re-litigation. On the other hand, States have justifiable reasons to refuse to enforce foreign judgments the same way they grant their own judgments premised on the view that foreign procedure is deficient. This book analyses the status of recognition and enforcement of foreign judgments in civil and commercial matters in Rwandan legal system.
