Mediation supposes an existing controversy. A third party comes forward to make up the breach. Hence the official title, mediator. The mode of mediation must depend upon the nature of the offence, and the dispositions of the parties. If the offence is of that description which will admit of its being passed over without a legal satisfaction, the mediator may bring about a reconciliation, in so far as the offended party is concerned, by simple intercession; but, if the offence is of such a character as to injure the honour of public law, or to violate the rights of public justice, reconciliation can only be brought about by mediation, in the way of the mediator's giving that satisfaction in the room of the offender which the law requires.
