Excerpt from Select Theses on the Laws of Holland and Zeeland: Being a Commentary of Hugo Grotius Introduction to Dutch Jurisprudence, and Intended to Supply Certain Defects Therein, and to Determine Some of the Celebrated Controversies on the Law of Holland
The following Translation of Van der Keessel's Theses Seleet? will, it is hoped, be found acceptable to the Profession, in those British colonies where the Roman-Dutch Law still obtains. The treatise of Grotius, a translation of which has been published by Mr. Herbert, of British Guiana, required, after the lapse of nearly two centuries, much comment and alteration; and the present Work, together with the Reehtsgeleerde Observation, published in 1778 by a Society of Dutch Advocates, of whom the celebrated Van der Linden was one, is perhaps indispensable as a companion to the Introduction to Dutch Jurisprudence. Some portions of it will necessarily be found inapplicable to the colonies at the present day; but it has been thought advisable to publish a translation of the entire book, in order to avoid the risk of omitting any portions, which, though not applicable to one colony, may be of use in another.
The Translator has spared no pains in endeavouring to render the translation correct and reliable: and has indeed deferred its publication for nearly a twelvemonth, in order to compare it with the various authorities cited throughout the book, and by submitting some portions of it to the judgment of others, to assure himself of the general correctness of his renderings.
