The leave procedure is used primarily by lawyers and the courts as a necessary first step to obtaining judicial review of government acts. It is, therefore, in the forefront of the regulation of public officials that touches the social, economic and political well-being of the people. The procedure for instituting judicial review actions under Order 16 of the National Court Rules, however, is a relatively new field of legal practice in Papua New Guinea. The novelty as well as the technical nature of this procedure presents many problems to judges and legal practitioners.
